Experience

Jason T. Gray is a new member of the DWGP team, joining the Firm in April 2008. Prior to joining DWGP, Mr. Gray served as Litigation Counsel for the Kansas Corporation Commission, where he represented the Commission before the Federal Energy Regulatory Commission, the Southwest Power Pool, the Kansas Legislature, the Kansas Court of Appeals, and various Kansas district courts. Mr. Gray also represented the Commission’s technical staff in administrative matters before the three-commissioner panel. In this capacity, he focused on electric and gas rate cases, mergers and acquisitions, and transmission line siting matters.

In his representation of the Commission, Mr. Gray monitored electric, gas, and liquid pipeline proceedings before the Federal Energy Regulatory Commission and advocated on behalf of the balanced interests of utilities and consumers. For example, Mr. Gray played an instrumental role in coordinating the efforts of the Kansas Governor’s Office, the Kansas Congressional Delegation, and a contingent of small Kansas gas producers to successfully oppose proposed gas quality standards, which would have shut-in significant amounts of Kansas gas. He also worked to ensure low fuel costs for retail customers and worked to balance the interests of Kansas wholesale electric suppliers and purchasers, while promoting the Commission’s conservation goals. He promoted equitable cost allocation in the Southwest Power Pool, the Regional Transmission Operator for Kansas electric utilities, and represented the Commission in encouraging transmission line development to support reliability and the development of renewables.

During the 2007-2008 Kansas legislative session, Mr. Gray worked to successfully oppose a transportation bill that would have reduced Kansas’ allotment of federal highway funding by millions of dollars. He also monitored legislation regarding Sunflower Electric Power Company’s proposed Holcomb Power Plant and drafted testimony submitted to the Kansas House Utilities Committee regarding the impact of the bill.

In representing the Commission’s staff, Mr. Gray served as lead counsel on the Kansas component of Black Hills Corporation’s $940 million acquisition of Aquila, Inc.’s Kansas gas distribution system and assisted in Mid-Kansas Electric Company, LLC’s $252 million acquisition of Aquila, Inc.’s Kansas electric system. In numerous retail gas and electric rate proceedings, Mr. Gray represented the Commission’s staff regarding cost of service, revenue requirements, rate design, decoupling, and service reliability. On appeal of one of these matters, Mr. Gray assisted in successfully arguing before the Kansas Court of Appeals to uphold the Commission’s decision regarding retail treatment of flowed-through transmission costs which were approved by the Federal Energy Regulatory Commission. Additionally, Mr. Gray represented the staff in transmission line siting matters.

Since joining the Firm, Mr. Gray has worked on electric and gas regulatory matters and regularly assists in the Firm’s representation of California municipal utilities. He also assists with project development and state regulatory matters.
